Terms and Conditions

1. Purpose and acceptance of the terms

These Terms and Conditions (hereinafter "the Terms") govern the use of the [platform/website name] platform (hereinafter "the Platform") and the relationship between [Club Name] (hereinafter "the Club", "we") and the parent/legal representative enrolling a child (hereinafter "the User", "you") in the sporting activities organized by the Club.

By checking the acceptance box during enrollment or by using the Platform, you confirm that you have read, understood, and accepted these Terms, as well as the associated Privacy Policy.

If you do not agree with any of the provisions below, please do not use the Platform and do not complete the enrollment process.

2. Enrollment conditions

• A child's enrollment is carried out exclusively by their parent or legal representative, who assumes responsibility for the accuracy of the data provided.
• Enrollment requires: the child's data (name, date of birth, photograph), the parent's/legal representative's data, and, where applicable, a sports medical certificate.
• The Club reserves the right to request additional documents (e.g. birth certificate, medical certificate) before confirming enrollment.
• Enrollment is confirmed only after the data has been validated by the Club and, if applicable, the registration fee/membership fee has been paid.
• The Club reserves the right to refuse or suspend an enrollment in the event of incorrect or incomplete data being provided.

3. Rights and obligations of the Club

The Club undertakes to:

• Organize sporting activities (training sessions, competitions) in accordance with the communicated schedule;
• Provide qualified coaching staff for the children's sports training;
• Notify parents of any relevant change to the schedule or participation conditions;
• Process personal data in accordance with the Privacy Policy.

The Club reserves the right to:

• Modify the training/competition schedule for objective reasons (venue unavailability, weather conditions, federation decisions, etc.);
• Temporarily or permanently exclude an athlete from the Club's activities in the event of non-compliance with the code of conduct (Section 8) or outstanding unpaid fees;
• Amend these Terms, with prior notice to Users as set out in Section 11.

4. Rights and obligations of the parent/legal representative

The parent/legal representative undertakes to:

• Provide accurate, complete, and up-to-date information about the child;
• Inform the Club of any medical condition relevant to the practice of the sport;
• Ensure the child attends training sessions/competitions properly equipped, in accordance with the Club's instructions;
• Pay any applicable fees/membership dues by the due date;
• Comply with the Club's code of conduct, both personally and through the enrolled child's behavior.

The parent/legal representative has the right to:

• Request information about the child's sporting activity and development;
• Withdraw the child from the Club's activities, in accordance with the withdrawal policy (Section 6);
• Exercise the GDPR rights described in the Privacy Policy.

5. Fees and payments

• Enrollment/participation in the Club's activities may involve a registration fee and/or a monthly membership fee, the amount and payment terms of which are communicated separately at enrollment;

• Failure to pay the membership fee by the due date may result in the temporary suspension of the athlete's participation in activities until the situation is resolved.

6. Withdrawal/cancellation policy

7. Limitation of liability

• Playing basketball carries an inherent risk of injury. By enrolling the child, the parent/legal representative confirms they are aware of this risk.
• The Club takes reasonable steps to ensure a safe training environment (qualified staff, appropriate equipment), but cannot guarantee the absence of any incident.
• The Club [holds/does not hold — to be completed] an insurance policy for registered athletes; details on the insurance coverage are available upon request.
• The Club's liability is limited to proven fault in the organization of sporting activities and does not extend to events beyond its control (fortuitous event, force majeure, conduct of third parties).
• The Club is not liable for any damage caused by the athlete's/parent's failure to comply with technical instructions or the code of conduct.

8. Code of conduct and discipline

• Athletes and parents/legal representatives are required to show respectful behavior toward coaches, teammates, opponents, and officials;
• The following are not tolerated: verbal or physical violence, discrimination, and conduct that endangers the safety of other participants;
• Violation of the code of conduct may result, depending on severity, in: a warning, temporary suspension, or permanent exclusion from the Club's activities, without the right to a refund of fees already paid.

9. Intellectual property

• The Platform's content (text, images, logo, graphic elements) is the property of the Club or is used with the consent of the rights holders, and is protected by copyright legislation.
• Photographs of children submitted at enrollment remain the property of the family; their use by the Club is carried out exclusively within the limits of the consent granted, in accordance with the Privacy Policy.
• Reproduction, distribution, or commercial use of the Platform's content without the Club's written consent is prohibited.

10. Governing law and dispute resolution

• These Terms are governed by Romanian law.
• Any dispute that cannot be resolved amicably will be submitted to the courts having jurisdiction over the Club's registered office, except where the law provides otherwise (e.g. consumer protection).
• Users have the right to contact the National Authority for Consumer Protection (ANPC) or, for matters related to personal data, the National Supervisory Authority for Personal Data Processing (ANSPDCP).

11. Amendments to the Terms

The Club reserves the right to update these Terms. Significant changes will be communicated to Users via [email/platform notification], at least [e.g. 15 days] before they take effect. Continued use of the Platform after that date constitutes acceptance of the revised Terms.
